Only a week after a structured settlement transfer petition was submitted by one NASP member from South Florida, an October mailer from another company to the very same annuitant came back with a yellow sticker over the address in the transfer record as " Forwarding Time Expired  Return to Sender' with an address in Upstate New York.

A review of the transferor's prior structured settlement factoring transactions taking place in Florida and other records obtained from our sources, shows the 51 year old annuitant has applied for a voter registration card in Upstate New York on  6/14/2011. Yet on 10/31/2011 only 11 days prior to entering a structured settlement transfer petition involving another NASP member (not from South Florida)  on 11/11/2011, the annuitant registered for another voter registration card, this time in Florida. While the individual appears to have a Florida driver's license applied for March 8, 2012, the records appear to show registrations of vehicles in New York, but none in Florida, according to our sources.

The current structured settlement transfer petition was the second submitted by the same annuitant Sumter County Florida in 2013, Judge Michelle Morley presiding.

A representative of NASP contacted me after I  posted

Structured Settlement Cash Now Forum Shopping Investigation-1 on October 1, 2013  and

Structured Settlement Factoring Frauds on Florida Courts… Developing  on September 29, 2013.

NASP wants people to know that it takes forum shopping seriously.

The individual I spoke with had ideas which company I was referring to then. I can say this, in the above described instance we have another set of players. Moreover, I learned today that the case described in my September 29, 2013 post was subsequently submitted by yet another NASP member (not from South Florida). That company was apparently having some of its deals funded by yet another NASP member (from South Florida) and the second NASP member on review determined that the annuitant was not domiciled in Florida. The transfer petition was then withdrawn.

IRC 5891 and various state structured settlement protection acts, including the Florida structured settlement protection act,  were meant to give confidence to sellers and buyers of structured settlements  not to be "in and out" as part of a 3 ring circus with Judge Michelle Morley as the ring master. When a company of group of individuals abuse the laws it undermines the industry's credibility with consumers and lawmakers in Washington and the various states and is harmful to the industry.
