I write to you as my Governor, Secretary of State and Attorney General with a fundamental business problem.

You see, Settlement Funding, LLC, which does business as Peachtree Settlement Funding, has held itself out as doing business in our State. This listing appeared in this company’s membership profile for a trade association called the Society of Settlement Planners, Inc.***

The West Hartford Law Firm of Kroll, McNamara, Evans & Delehanty  lists Peachtree Settlement Funding on representative list of clients.

However, a search of C.O.N.C.O.R.D. shows no listing for Settlement Funding, Settlement Funding, LLC or Peachtree Settlement Funding

Questions that I and other concerned citizens and registered voters would like answered.

  1. Why is this company allowed to operate in our state without filing?
  2. Is this company engaging in the solicitation and conclusion of structured settlement factoring transactions with Connecticut state residents?
  3. How long has this company been operating in our state?
  4. Are they filing tax returns for income earned in the state?

Some of this information can be obtained from public court records filed since the Connecticut Structured Settlement Protection Act was created.

It is my belief that this is just the tip of the iceberg and that many more such companies practice in our state under similar circumstances. The Kroll, McNamara, Evans & Delehanty  list includes at least one other entity, Novation Capital, which has no C.O.N.C.O,R.D. listing.
