Structured Settlements 4Real®Blog 2026

Structured settlements expert John Darer reviews the latest structured settlements and settlement planning information and news, and provides expert opinion and highly regarded commentary. that is spicy, Informative, irreverent and effective for over 20 years.

Patrick Hindert has posted a review of the NSSTA Annual Meeting on his S2kM blog. He makes a number of good observations but I simply can't get my arms around why he keeps pushing this issue on transfers (a/k/a factoring of structured settlement payment rights, a/k/a cash now).

I think NSSTA has made it clear in its amended bylaws what it is all about and factoring is not it. While I am not totally against factoring, in certain circumstances, I don't think it is a good fit for the NSSTA.

The Society of Settlement Planners lost its way when its Board started the ridiculous "factoring is settlement planning" mantra

Its association with factoring has caused SSP serious problems in membership recruitment.  How can it be taken seriously? Fortunately for its members, the NSSTA will not be seduced by the same trap.

While I respect his writing skills I'm disappointed that Patrick Hindert has given any credibility Professor Chermerinsky's opinion while not highlighting the potential double dipping being done by those who create structured settlements on the one hand, make a commission and then broker the sale of structured settlement payment rights on the other hand, for another commission.
