The Investment Advisers Act generally prohibits the use of testimonials. The Securities Exchange Commission ("SEC") has consistently confirmed this position that testimonials are misleading and cannot be used in advertisements seeking advisory business.
For settlements planners and structured settlement advisers advertising services that might be deemed advisory (and there are a few of them), the limitation applies to sales and marketing materials, including web sites!
If you are a settlement planner or structured settlement adviser be careful to note that your posting of testimonials from a trial lawyer, law firm, client, trial law or bar association, or current or former elected official on your web site or included in your sales and marketing materials could get you in hot water with regulators!
