Structured settlement annuitants DO NOT have the right to factor (sell) their structured settlement payments, according to Matt Bracy, the President of the National Association of Settlement Purchasers (NASP) in a video posted on the Factoring Channel, on November 7, 2011. Bracy, who is also General Counsel of the factoring company Settlement Capital, states however, that annuitants:
- DO have the right to receive the structured settlement payments (that have been agreed by contract, in the settlement agreement)
- DO have the right to go to Court, to try and convince a judge that selling some or all of their right to receive the structured settlement payments is in the best interest of the annuitant and any dependents (if applicable) . Ultimately the judge decides.
