James Street, President of The James Street Group, known for its largesse to Trial Lawyer Associations nationwide oddly appears on the April 27, 2007 broker list for the United States Department of Justice.
Dueling Absolutes Induced Fumble
It’s odd because the posted philosophy of The James Street Group is that “The James Street Group began with a simple idea – to ensure that plaintiffs and the plaintiff’s counsel have their own expert in structured settlement negotiations. Rather than relying on the defendant to assist with your structured settlement, our specialists work only for you, the plaintiff”
As we’ve seen from our exposes of certain consultants of Forge Consulting and High Impact Structures, LLC, to get on the same United States Department of Justice list of annuity brokers you must sign this declaration under the federal perjury statute which, in part, says that you have provided substantial services to or on behalf of defendants or their counsel, in each of the last 3 years. It is clear in all the published materials that the purpose of the list is to assist Assitant United States Attorneys in their selection of structured settlement brokers to represent the United States. To appear on the April 27, 2007 list Mr. Street would’ve had to sign that declaration between January 1, 2007 and the date the list was published.
It appears that the “Longhorn” of mutually exclusive statements has impaled the celebrated Mr. Street, who I otherwise think is a good guy.
Research indicates that Mr. Street also appeared on the December 19, 2006 USDOJ Annuity broker list. Evidence in the hands of the USDOJ would reveal that Mr. Street signed a declaration attesting to the “substantial services he has provided to defendants or their counsel in each of the past 3 years” Now that the spotlight has been shown on him, I hope that he lives up to his “integrity” and contacts the USDOJ Civil Division and. for the sake of the industry, withdraws his name.
As of May 6, 2007 James Street appears to be the ONLY structured settlement broker who defines with the absolute “plaintiff only” yet appears on the United States Department of Justice annuity broker list, which requires substantial defense work in preceding years.
MORAL OF THE STORY
- If you market yourself as “plaintiff exclusive” or “plaintiff only”, just follow the rules..
- If you aren’t truly “plaintiff only” or “plaintiff exclusive” , given an under penalty of perjury declaration, then don’t market yourself as such or, don’t sully our industry with what amounts to false advertising that affects the target market’s perception of others.
- Stay away from absolutes unless you really mean them. Be mindful of mutually exclusive fumbling..
