New York Structured Settlement Transfer “Hide and go Seek” | In The Matter of And vs None

So Let’s Play!

A creative Florida structured settlement factoring company has submitted a New York structured settlement transfer petition in Queens County with the caption In the Matter of And vs None.

Because the competition is fierce (there’s more poaching in the structured settlement secondary market than Sunday morning brunch at your local diner), some companies come up with “ingenious” ways to get an edge to fool the competition.

One company even named an LLC after two nacho chips (Dos Nachos LLC ).

It didn’t take long to determine which member of the National Association of Settlement Purchasers the pending New York deal was associated with And vs None, given that multiple prior deals were with a single NASP member and there were common relationships between the Optimum Funding Solutions LLC and a family foundation of the principal of the single NASP member.

If Dos Nachos and And vs None can make it onto petitions, the following possibilities don’t feel that far‑fetched.

  1. In the Matter of Dos Nachos vs Tres Leches
  2. In the Matter of May vs Shall
  3. In the Matter of Wiley vs Reilly
  4. In the Matter of Shallow vs Hal
  5. In the Matter of Vanilla vs Chocolate
  6. In the Matter of Fuchsia vs Pink
  7. In the Matter of Tinky vs Winky
  8. In the Matter of Pineapple vs Pine Nut
  9. In the Matter of Tit vs Tat
  10. In the Matter of Schmutz vs Putz
  11. In the Matter of Iguanna vs IGuano
  12. In the Matter of Tictac vs Toe
  13. In the Matter of Eenie Meanie vs Miney Moe
  14. In the Matter of Tilde vs Apostrophe
  15. In the Matter of KPop vs LMNOP Bop
  16. In the Matter of LaLa vs Baa Baa
  17. In the Matter of Boogie vs Boogaloo
  18. In the Matter of Bazaar vs Bizarre
  19. In the Matter of Elephant vs Relevant
  20. In the Matter of Candy vs Can Do

Hide and Seek may be a children’s game, but in this industry it’s practically a business model. In a market where Dos Nachos and And vs None actually happened, the line between satire and docket entry stays dangerously thin.
