Nobbys Beach , the home of good surfing and the proxy registrar of Freedom1stfunding.com (the website that all pilfered traffic in a certain redirect scheme has redirected to since February 2012) is also the home of whatarestructuredsettlements(dot) org which contains some of the worst drivel on structured settlements I've ever seen. Total unadulterated social media road kill.
The stated goal of " The Structured Annuity explained" is to clarify what a structured annuity is. Here's what "they" say, followed by my comments after each statement:
A. "A structured annuity is when an insurance company gives out cash installments as payment to a qualified individual (for occasion, he suffers an accident taken care of by insurance)."
Comments:
-
Structured annuity use is not limited to insured cases. Cases may be settled using structures where the defendant or respondent is uninsured, or the case settles within a self insured retention (which is similar to a deductible).
-
Structured settlement are not limited to accidents. To wit, IRC 104(a)(2) provides a tax exclusion for income related to physical injury OR physical sickness.
B. "During a set amount of time, cash payments will periodically be made (sic). Generally, this time period last (sic) as long as the applicant is alive. The cash installments may be paid through (sic) a variety of ways, including subsequent (sic) a flat-rate amount, cash settlements and even lump sums".

C. You force wonder, what is the underlying mechanism that drives structured annuity settlements?

OK Obi-Wan
D. "A structured annuity settlement is a long duration contract, hence it becomes imperative that the public involved (especially the person who is entitled to receive it absolutely know the subsequent components: the policies for settlements, the payment schedule, the amount of each payment, and where it should be sent".

One of the benefits of a structured settlement is that it is flexible and may contain more than one payment stream. Payment streams can be long, short, increasing, decreasing, stepped up, stepped down, and more. Generally a structured settlement is a private transaction, although some structured settlement factoring companies have been known to "sniff" court records for prospective targets to solicit.

3. I think the person who is entitled to receive the payments or, if applicable, the trustee or guardian should be providing payment directions when the structured settlement is created and the structured annuity purchased. If less than 100% of structured settlement payment rights are subsequently sold, then payments may be serviced by, and flow through, a third party as opposed to being paid to the annuitant directly by the annuity issuer.
E. "What are some of the pros to structured annuity settlements? Persons who get settlement disbursements can look forward to long-range financial concord of mind. Additionally, the money for annuity agreements is tax-free, on the condition that payment structures would stay the same as per the original covenant".
1. Concord" – a grape or " a grammatical logic or coherence in the links between parts of a sentence". Love the irony!
F. "For occasion, someone is supposed to receive $2,500 per payment. While in 2009 this force be significantly high, as inflation along with uncommon variables (reasons like an economic depression, etc). The value of this will reduce over time. A lump sum can be obtained and is desirable to a structured annuity".
Comment:
- Check out that second sentence. It's totally incoherent. Actually the whole thing is incoherent.
- There has been little inflation since 2009
- One structured settlement purchasing broker notably created an advertising campaign and urged people to sell their payment rights in 2010, when history has proven that they would have lost money taking his advice.
-
If a lump sum is so desirable how come some of these "cash now pushers" are so aggressive about tempting you to sell, even if you don't have a real need to sell? Think about it! They want to buy what you don't need to sell at a discount so they can sell it to someone else and make a profit.
G. "Here are numerous useful websites about structured annuities: http://www.structured-settlements-guide (dot) com and http://www.integrityfunding (dot) net/".
-
Not one legitimate structured settlement annuity information source. Both websites are directly or indirectly associated with the purchasing of structured settlement payment rights, which are NOT structured annuities.
- Integrity Funding is Virginia Dunn's company. Here's our previous commentary on "Ginny Dunn's marketing". Back in 2007 Ginny was hocking Integrity's structured settlement purchasing services using a testimonial of someone who purportedly sold their structured settlement fro a percentage of the discounted present value, invested in Mannatech company stock at $8 and it increased to $20, 6 months later. Close of Mannatech July 6, 2012 $7.50
H. Within the USA, for occasion, Federal IRS statute 104 provides a description of structured settlement).
Comments:
- Wrong again. IRC 104 covers exclusions from income. IRC 5891 contains the only definiton of structured settlement that appears in the Internal Revenue Code of 1986, as amended.
- "For occasion"?
I. "That’s all (sic)here (sic) is to it!"
Stewie's nonverbal cues say it best!

- Why is it so hard to do a little bit of research and get it right?
- No wonder they registered the website anonymously. If this was my material I'd have a "paper bag" on my head too.
