While Article 50-B of the New York Civil Practice Law and Rules (CPLR) is most commonly associated with the payment of damages in personal injury and wrongful death actions, the title of the statute reads “Periodic Payment of Judgments in Personal Injury, Injury to Property and Wrongful Death Actions”.
To the extent that damages* in property damage litigation extend into the future and exceed the $250,000 statutory threshold, the litigants could benefit from the services of a New York CPLR 50-B Expert to analyze the exposure. As with actions for personal injury the low discount rates combined with the statutory growth rate create an advantage for plaintiffs. in such actions where there is good liability.
