Structured Settlements 4Real®Blog 2026

Structured settlements expert John Darer reviews the latest structured settlements and settlement planning information and news, and provides expert opinion and highly regarded commentary. that is spicy, Informative, irreverent and effective for over 20 years.

It has been reported by various sources that ELNY structured settlement annuitants who experience payment reductions may be eligible for some relief from the ELNY Hardship Fund, a $100 million pot of money to be funded with voluntary contributions from a variety of life insurance companies. To some it sounds promising, but there has been little information about the fund. A call this author made to the ELNY Hardship Fund information line earlier this year was met with the recording that an administrator has not yet been appointed. That was still the case today when I called.  This time however, I was able to reach a live person who said that ELNY structured settlement annuitants who experience shortfalls WILL (EVENTUALLY) BE NOTIFIED by the administrator. Unfortunately for those seeking certainty, who are asked to be patient, the time frame is uncertain. The ELNY Hardship Fund contact could not give a time frame when an administrator will be named,  procedures will be in place, notifications will go out and money will flow.

Telescope_moon_gaze_lg_clrLike the punchline to the Natasha Bedingfield lyric, “the rest is still unwritten“.  ELNY annuitants want to know when the ELNY Hardship Fund will begin to open up “that dirty (ELNY) window”

Figuratively speaking, let’s hope the hardship payments for eligible  ELNY annuitants are closer than the moon is to this telescope-–———————————>

Considering that there was an announcement made back in December of 2007 by the NY Liquidation Bureau and Governor Eliot Spitzer, to announce $600M was invested to keep 100% of the Annuity recipients whole, and it never happened…:

I wouldn’t exactly be holding my breath waiting for the latest promise made by the same Liquidation Bureau, for an “Executive Life Insurance Hardship Fund,” to save the day.

This is being handled so carelessly, they won’t tell us when the reduction in payments will begin, we can apply for the hardship fund because no one has been appointed to head the program, I don’t have a contract owner to fall back on for the loss I will experience and I am sitting here climbing the walls wondering when I need to file my bankruptcy.
I’m sure the guidlines will be such that I will not qualify and so why make me wait? Just tell me now and give me some timeline so I don’t have to stress myself in health issues!
This is taking it’s toll on me and my loved ones. I am suppose to take injustice after injustice, unfairness after unfairness and say “Oh well they can’t help it, their out of money”! That was my compensation for my LOSS!
Yet it doesn’t matter to them they are killing my husband all over again.
Dredging all of that back up for me and my family to relive.
    This is all unblieveable!

Climbing the walls is a very accurate statement. It’s been a hellish 4 1/2 months since this all began. Now we still have no idea when this Hardship Fund will be put into place, how we would even qualify because OF COURSE they are going to make it impossible for us to qualify, and even IF we did, how much would we even get?, and what about for the months that we will “lose out” before it is implemented?
I am going to lose 53% of my check. I have 3 minor children to support. We are facing numbers that qualify for state assistance. 1992 check on 2012 prices, with three growing boys approaching teenager status. I don’t see how this is supposed to work. The ends of the rope aren’t going to meet, no matter how hard I try.
The scumbags should AT LEAST give us the closing date and our dollar numbers, so that we can at least sleep at night (maybe) and save ourselves the future heart attack, other health problems and soaring health care costs. I guess those mortality tables will be put to good use. A great way to kill us all and pad their own pockets even more!
