In denying a petition to factor structured settlement payments to Peachtree, the Pennsyvania Court of Common ruled April 7, 2009, in the matter of "In Re: Anne G. Jenkins, No. 2090 C-1044 that Peachtree's terms were "unreasonable and unfair" (effective discount rate of 26.33%!)
Notably, the standard "level of professionalism" associated with "the leader in the marketplace" faced significant concerns from the Court regarding:
- Payee's lack of employment
- Lack of established record of employment
- The payee didn't even know the amount of her monthly rent.
