The Declaration that is required to be signed by Structured Settlement Annuity Brokers wishing to get on the United States Department of Justice list requires it be made under penalty of perjury. Exactly what is perjury?
According to Wikipedia:
"Perjury is the act of lying or making verifiably false statements on a material matter under oath or affirmation in a court of law or in any of various sworn statements in writing. Perjury is a crime because the witness has sworn to tell the truth and, for the credibility of the court, witness testimony must be relied on as being truthful. Perjury is considered a very serious crime as it could be used to usurp the power of the courts, resulting in miscarriages of justice. In the United States, for example, the general perjury statute under Federal law provides for a prison sentence of up to five years, and is found at 18 U.S.C. § 1621. See also 28 U.S.C. § 1746."
One of the statements on there relates to a declaration about performing substantial defense services "in each of the last 3 years". If you solicit to plaintiff attorneys and injured parties and hold yourself out to the public in print or verbally that you are "plaintiff exclusive" that is a business choice. However in your business choice you logically cannot be anything else and logically, if you sign, or have previously signed, the 50.24 DOJ Declaration you are THEN committing perjury, to our country, or false advertising to the public that you purportedly serve. And you bring disgrace to our good industry that should not be tolerated.
It is clear, from reading the materials, that the purpose of the DOJ list is to get business from the United States Department of Justice. If you are on that list, and have no intention of serving our country in the capacity of structured settlement annuity broker, then you need to look yourself in the mirror and ask yourself if you like sleeping in your own bed, the comfortable living afforded to you by being part of our industry, and your reputation.
THIS IS SERIOUS STUFF! If you have signed the 50.24 Declaration with NO intention of serving the United States, this is not just a knuckle rap. YOU are exposing yourself to the end of your structured settlement, AND insurance AND securities career (if you are so licensed) AND you just may end up in jail.
