Simon Sheldon's Structured Settlement Tips  "STRUCTURED SETTLEMENT EXPLAINED"
A structured settlement always begin with a lawsuit being filed and the plaintiff (you or the person who filed charges) winning the case. The defendant may be required by the court to pay a certain amount of money to the plaintiff for physical, emotional damage et al.

Structured Settlements 4Real  A lawsuit begins when a legal document called a complaint is filed with the Court of jurisdiction. The complaint sets forth certain allegations of fact that have to be proved, through the judicial process, in order to support the "counts" (not charges) brought by the plaintiff in the complaint. Charges are something you typically see in a criminal complaint (or your credit card bill) not a civil complaint. On the other hand, a structured settlement on begins with an agreement to settle, a compromise…also known as "a meeting of the minds".

Simon Sheldon's Structured Settlement Tips Now, regardless of who proposes the idea, structured settlement is usually an option that's brought up when the defendant is obliged to pay for damages cost to the plaintiff.
More often than not, structured settlements involve the purchase of annuities to ensure that the defendant would(sic) be able to fully comply with his future obligations.

Structured Settlements 4Real As stated in my commentary above, a structured settlement is the result of a compromise. . An obligation to pay future structured settlement payments (future periodic payments) is created in the documentation for the structured settlement. The purchase of an annuity itself is not enough to assure that the defendant will comply with its future obligation. Prior to the time when qualified assignments were used with regularity the defendant  or its insurer actually owned the structured settlement annuity and the plaintiff was a general creditor of the defendant. If the defendant  or its insurer went bankrupt the plaintiff had no security interest and stood in line with everyone else. These days most structured settlements involve qualified assignments pursuant to IRC 130(c). With a qualified assignment the obligation to make those structured settlement payments becomes the obligation of the qualified assignee.

Simon Sheldon's Structured Settlement Tips LAWS REGARDING STRUCTURED SETTLEMENT
A structured settlement must always be amenable to both parties. If the plaintiff is completely against the proposal, the defendant may have no choice but to give in to the plaintiff's demands as he usually has all the rights to call the shots in this situation.

Structured Settlements 4Real Exactly how is the above statement a law? The statement is false. Ask anyone who has ever had a case with Hartford Fire and wanted to structure with an annuity issuer other than Hartford Life. Sure you can take a negotiating stance but nobody has to give in if they don't want to our can't due to corporate policy.

Simon Sheldon's Structured Settlement Tips BENEFITS OF STRUCTURED SETTLEMENT
Tax Avoidance – If your structured settlement is being handled by a lawyer with considerable expertise in this field, rest assured that you can enjoy tax reductions at the very least. As for the best-case-scenario, there's always a chance that you can enjoy a tax-free structured settlement!

Structured Settlements 4Real  Its always prudent to work with a competent professional when creating a structured settlement. It is a good idea for lawyers to retain their own structured settlement specialist to mitigate liability exposure in a field that may not be covered by their Errors & Omission insurance. A structured settlement by its definition under the Internal Revenue code at IRC 5891 is tax free because the damages in a structured settlement are those characterized under 104(a)(1) and 104(a)(2). Anything else might be called a structured settlement but it would not technically be a structured settlement. Sometimes a non qualified assignment is referred to as a non qualified structured settlement. Tax reduction will not occur with a structured settlement. Why? If you are the recipient of damages which can be characterized in a true structured settlement then those damages are received by you tax free, whether in a lump sum, or as future periodic payments .

Simon Sheldon's Structured Settlement Tips Be on guard against lawyers who indulge in self-dealing without informing the parties involved; you never know when they might turn on you next.

Structured Settlements 4Real Shouldn't that be in "legal tips?"
