Sharing my experience yesterday should generate some added motivation for the structured settlement industry to get with it on the factoring company abusive structured settlement advertising issue. I was before a judge to assist an attorney in the judicial approval of a qualified settlement fund. We walk in and the judge confuses me for a representative of a factoring company** and goes off on a rant.  I let him rant. I know he's just concerned about the infant plaintiff. Then I told him about my blog, that I agreed with him and that I actually created structured settlements. This brought a smile from the judge and progress ensued on the case. So those structured settlement cash now buggers are confusing the judges too! That's all we need.

As an aside this case should never have had to be resolved through a QSF. But after 5.5 months of jerking around by the defense ("gotta work with our broker, we don't know who our broker is,  we won't structure, we will now, we won't now, cant fund by the date we agreed to 2 months ago, can't get check now), there was no other choice. Even the defense structured settlement broker couldn't get it done. The sad thing for the defendants themselves in this matter was that they totally blew a good PR opportunity on a terrible case. The self insured defendant, who was not my client, also likely incurred needless TPA and legal fees while this file was kept open. If you want to make structured settlements work for you then learn when to let go.

** unless I've got a body double somewhere nobody who knows me or heard of me would ever confuse me for a factoring company representative.
