Proof of Life (i.e. ” I’m not dead yet”) is required when you are the measuring life of life contingent payments. An annuiy issuer wants to emet its obligations but protect itself against overpayment or in extreme circumstances, against fraud. Life contingent payments cease upom death. Proof of life is also required in certain circumstances where payments are made to someone who lives outside of the United States and verification of life cannot be made via the Social Security Number.

Wilcac Structured Settlements, Inc. has filed a lawsuit against Canan and Hayrullah Ipek, seeking the recovery of $272,266.14 for overpaid benefits following their son Ekincan’s death in 2016. The overpayment occurred due to delayed notification of his passing, violating the structured settlement terms. The defendants are currently in settlement negotiations.
