Joseph E. Gargan Jr. (“Joey Gargan”), the former CEO of The Pension Company, Inc., convicted felon and former federal inmate has lost his complaint asserting claims for violations of his civil rights pursuant to Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971). Gargan’s claims were DISMISSED pursuant to 28 U.S.C.§ 1915(e)(2)(B)(ii)-(iii). The clerk wass DIRECTED to close the case, SO ORDERED, on September 25, 2023.

Gargan was a former CEO of The Pension Company, Inc. who had the temerity to pilfer settlement money funded with taxpayer dollars to cover his own shortfalls.

While in a position of trust, Gargan even embezzled settlement money from a New York City area hospital that was intended to fund a stuctured settlement for a severely injured minor.

He also shortchanged structured settlement brokers who were associated with his firm.

Despite his crimes, Gargan was vouched for by Kenneth Feinberg and is the son of the late Joseph E. Gargan, “best known being a lawyer and cousin of Senator Ted Kennedy, prominently involved in the infamous Chappaquiddick incident of 1969” Source: Biography.com 

Gargan’s Bivens claim was filed after Gargan was granted compassionate release from FMC Buttner
