“I Have a Structured Settlement and I Need Oversight Now! The Consumer Financial Protection Bureau and the Structured Settlement Industry” is a paper authored by New Mexico law student Jeffrey L. Stradling, an Intern at the New Mexico Court of Appeals, Chambers of Judge Timothy Garcia, and published on SSRN in December 2013 that I will be reviewing in a subsequent blog post.
Why Has Einstein Structured Settlements shamefully copied what appears to be Jeffrey L. Stradling’s entire paper on a page at einsteinstructuredsettlements (cfp-in-theindustry.html)?
True to Form, Einstein Fluffs the Details
- They cite Stradling as Strandling
- They refer to him as a 2015 graduate of the University of New Mexico School of Law, when Stradling himself stated he is a member of the class of 2015 at the University of New Mexico School of Law.
- They cite Stradling as a CFP and he is not, in the URL containing the infringing content.
- There is no indication that Einstein has been authorized to reprint Stradling’s work.
The lesson to be learned is:
“Think before you use content, especially if you are displaying whole articles, large portions of articles and/or copyrighted images – even if you’re giving full attribution and linking back to the original author, this is not enough. Attribution actually has nothing to do with copyright law – it helps you avoid an allegation of plagiarism, but you are infringing an author’s copyright by displaying her (his) work. (emphasis added)
