Randall Shatto’s definition of “structured annuity” on AnswerBag.com, which is surprisingly listed as a “professionally researched Great Answer,” is woefully inadequate
Here’s what Randall says:
“A structured annuity is money you receive because of a settlement from a life insurance company or Treasury Bond Trust. When
you are injured, you may obtain a payment settlement. This typically comes in the form of payments. If you use a life insurance company or the Treasury Bond Trust, you will receive your payments on a regular basis”.
Comments:
- Payments from a Treasury Bond Trust are NOT a structured annuity
- If you receive payments from a structured annuity it is not because you settled with a life insurance company or Treasury Bond Trust.
- Technically you can also receive payments “from a structured annuity” if you have purchased structured settlement payment rights from someone else.
- An annuity is issued by a life insurance company
- There is no such thing as a “payment settlement”. You may settle for a lump sum, periodic payments of a variety of different types or a combination with such payments being made to a variety of different types of payees (e.g. Special Needs Trust, Spendthrift Trust, to you personally)
- Payments can be regular or irregular
