Heard "on the street" that a veteran defense structured settlement broker with a large national firm recently claimed that it is "constructive receipt" for the plaintiff if the defense broker were to agree to a split of commissions with the plaintiff’s broker. Add to this that the defense broker had previously split with the plaintiff broker many times before (on much smaller cases). That the size of the case determines "constructive receipt" is a new tax principle for me. There’s a good Yiddish word for it "Bubbe-Myseh". Here piggy piggy!
