Today's New York Post story " Ground Zeros" underscores the axiom that just because you start litigation does not guarantee you will come out a winner financially.
Throat cancer sufferer Edgar Galvis apparently thought it was a joke when he received a check drawn on the IOLA Account of Worby Edelman Napoli & Bern, LLP in the amount of $0. Yes that's ZERO dollars! That's the net amount of the proceeds from the settlement of Galvis' action against Merrill Lynch whose World Financial Centre offices were cleaned by Galvis and others after the 9-11 attacks.
$10,005 settlement amount for Galvis
$ -2,579 unitemized legal expenses
$ -2,124 1/3 legal fee
$ -352 fee paid to the referring lawyer
$-4,950 for unspecified "liens"
The net is zero. The July 31, 2011 New York Post, at page three, carries a picture of Galvis along with his "hefty" check, purportedly endorsed by William H. Groner and Marc Jay Bern. The check, reports The Post, was accompanied by an "it was our pleasure to serve you in this matter letter"
The Post continues to blast Glavis' lawyers by implication. On August 22, 2010 the Post carried a story about how Federal Judge Alvin Hellerstein was to conduct a hearing to investigate whether lawyers for 9/11 first responders in their case against the City of New York, can pass on loan interest costs to their clients or whether such costs represent overcharges.
